Terms of Service

These Terms of Service ("Terms") govern your access to and use of SetterLive (the "Service"). By creating an account or using the Service, you agree to these Terms. If you're using the Service on behalf of a business, you're agreeing on that business's behalf.

SetterLive lets businesses connect messaging channels such as WhatsApp, Instagram, and Facebook Messenger to an AI assistant that responds to inbound leads, qualifies them, and books appointments on the business's calendar.

The Service depends on third-party platforms, including Meta's WhatsApp Business Platform, Instagram, and Messenger APIs. Your use of those channels through SetterLive is also subject to Meta's own terms and policies (including the WhatsApp Business Messaging Policy and Meta Platform Terms), and you're responsible for complying with them.

You must provide accurate information when creating an account and keep your login credentials confidential. You're responsible for all activity that happens under your account, including any channels you connect to it.

You agree not to use SetterLive to send unsolicited bulk messages (spam), to message people who haven't consented to be contacted, or to send content that is illegal, deceptive, or infringing.

You must not use the Service in a way that violates Meta's platform policies, WhatsApp's commerce and business messaging policy, or any applicable law, including data protection and anti-spam regulations.

We may suspend or terminate access if we reasonably believe your use of the Service violates these Terms or puts our ability to operate on a third-party platform at risk.

You retain ownership of the conversation and lead data that flows through your connected channels ("Customer Data"). You grant SetterLive a license to process Customer Data solely to provide and improve the Service, as described in our Privacy Policy.

You're responsible for having the right to share any data you upload or connect to SetterLive, and for obtaining any consents required from the people who message your business.

Paid plans are billed on a subscription basis through our payment processor, Dodo Payments. Fees are charged in advance and are non-refundable except where required by law.

We may change our pricing with reasonable notice; continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

SetterLive and its underlying technology, branding, and content are owned by us or our licensors. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service.

The Service is provided "as is" without warranties of any kind, express or implied. AI-generated replies may contain errors, and we don't guarantee any particular business outcome, such as a specific number of booked appointments or conversions.

To the maximum extent permitted by law, SetterLive will not be liable for indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by a third-party platform we depend on, or if we discontinue the Service, with notice where reasonably possible.

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date, and continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
